LCR® LEFT CENTER RIGHT™ Dice Game Legal Disputes against Imagination Games are Not Over

October, 2009 — George & Company, LLC, ("George & Co.") is a four-generation family owned company and the maker of the popular, award-winning, original LCR® LEFT CENTER RIGHT™ dice game. George & Co. took legal action against Imagination Holdings Pty Ltd ("Imagination"/"Imagination Games") to stop what George & Co. believed to be a knock-off of its game.

When Imagination and its CEO Shane Yeend first decided to produce the game and use the name LEFT CENTER RIGHT—after Imagination heard of George & Co.’s game and actually used it to create Imagination’s game—George & Co. thought that was underhanded. "Because we believed that customers, vendors, and the trade already associated the name LEFT CENTER RIGHT with our game, we took legal action against Imagination to protect our brands," said George & Co.’s spokesperson. "For nearly two decades, we have used our tagline LEFT, CENTER OR RIGHT—DON’T LOSE YOUR CHIPS directly underneath our LCR trademark on our packaging and materials, as well as our unique LEFT! CENTER! RIGHT! chips-and-arrows design." That tagline and design appear below:

          

George & Co. also confirmed this week that, "One appeals court recently entered an order refusing to allow George & Co. to proceed to trial against Imagination. On other fronts, our proceedings against Imagination Games are ongoing." George & Co. currently has several other legal opposition proceedings against Imagination now pending and expects to broaden the opposition and legal efforts further.

"No court has ruled that Imagination may use George & Co.’s registered and incontestable LCR® trademark, nor has any court ruled that Imagination has any protectable trademark right to LEFT CENTER RIGHT," the company also confirmed.

As a result of decades of hard work and dedication, George & Co.’s LCR® LEFT CENTER RIGHT™ dice game has been recognized as one of the "Top 10 Most Wanted Games" for the past three years. Enjoyed for decades by generations of consumers, George’s original game has become a classic. To this day, other than Imagination, no one has claimed George & Co.’s LCR® LEFT CENTER RIGHT™ dice game is not original to George & Co.

This year, Zobmondo Entertainment LLC sued Imagination International Corporation for false advertising and unfair competition, among other things, and in 2007 ODVD sued Imagination Entertainment Limited for copyright and trademark infringement, among other things. Several other companies have filed legal trademark opposition proceedings against Imagination, including Hasbro, Mattel, Zobmondo, Paramount Pictures Corporation, and Apple, Inc.
